Elon Musk settled a class action lawsuit Thursday involving his political action committee, America PAC, which was accused of misleading Trump supporters in the 2024 presidential election with a fake $1 million lottery prize. The case centered on allegations that the winners were predetermined rather than randomly selected, despite claims made to voters in key battleground states.
Background of the Lawsuit and PAC Activities
In the lead-up to the 2024 presidential election, Elon Musk established America PAC approximately one month before voting day to support President Donald Trump’s campaign. The PAC encouraged Trump supporters to sign an online petition promoting “free speech and the right to bear arms” in exchange for entry into a lottery with a purported chance to win $1 million. Participants were required to provide personal identifying information to enter.
However, contrary to the lottery’s advertised random nature, the winners were allegedly chosen based on their suitability to act as spokespeople for the PAC. Philadelphia District Attorney Larry Krasner filed a legal challenge accusing Musk of running an illegal lottery. Despite this, a Pennsylvania judge allowed the payout process to continue after Musk’s attorneys argued that the winnings were payments earned, not lottery prizes.
Claims of Fraud and Marketing Exploitation
Multiple lawsuits were filed shortly after the election, including a complaint from Arizona resident Joy Havrick. Havrick claimed she was used as a “marketing prop” and argued she would not have participated or provided her personal information had she known the lottery was not random or that selection was based on favorability to the PAC.
Her attorney, Mark Bankston—known for representing Sandy Hook families and winning a defamation suit against conspiracy theorist Alex Jones—declined to comment on the settlement. The allegations highlighted concerns about deceptive political fundraising tactics and exploitation of supporters’ data.
Settlement Details and Court Proceedings
According to online court records, the parties reached a settlement and requested the court to vacate deadlines and stay further proceedings for 30 days to finalize the agreement and file a motion for preliminary approval. Details of the settlement, including any financial terms Musk may have agreed to, were not immediately disclosed.
Neither Musk nor his legal representatives issued comments following the settlement announcement.
Implications for Political Fundraising and Legal Oversight
This case underscores increasing scrutiny on political action committees and their fundraising methods. The use of purported lotteries or prize incentives tied to political petitions raises ethical and legal questions, particularly when participant data is collected and winners are selectively chosen.
The settlement may prompt closer examination of similar PAC operations during elections and highlight the risks political donors face in such campaigns.
While details remain limited, the resolution of this lawsuit closes a contentious chapter in the 2024 election cycle involving Elon Musk’s direct political involvement through America PAC.
