A federal judge on Tuesday sharply criticized the Justice Department for its unusual and improper handling of a criminal case against two former FBI officials tied to the Hunter Biden laptop probe. The case, unfolding in Washington, centers on accusations that the officials made false statements to Congress about their knowledge of a laptop allegedly belonging to Hunter Biden, son of former President Joe Biden.
Judge Strikes Down Unsigned Criminal Complaint
U.S. Magistrate Judge Zia Faruqui removed from the record an amended criminal complaint filed by the Justice Department late at night, which added a new obstruction charge against the ex-FBI officials, Nikki Floris and Bradley Benavides. The judge emphasized that such charging documents must be signed by a judge to establish probable cause, but the amended complaint lacked this critical approval.
“It is not our court’s practice — and I think it is appropriately not our practice — that unsigned complaints are filed on the docket,” Faruqui stated. He also questioned why the Justice Department deviated from its usual procedures, saying, “I want to know why the United States is reticent or averse to putting before a probable cause determination that you must believe is righteous. Why today on this one case have you changed the entire history of how you charge cases?”
Background of the Charges and Case Context
The criminal case accuses Floris and Benavides of falsely minimizing their knowledge about a laptop the Justice Department says Hunter Biden abandoned at a Delaware computer repair shop in 2019. The laptop’s contents, first reported by the New York Post, allegedly include emails relating to Hunter Biden’s foreign business dealings.
The case has become a politically charged matter amid ongoing Republican criticism of a now-disbanded FBI Foreign Influence Task Force, which the accused officials led. The task force was established during the Trump administration to monitor foreign influence campaigns but came under fire from Congressional Republicans who claimed it tried to discredit their investigations into the Biden family.
Legal Challenges and Procedural Issues Highlighted
At the Tuesday preliminary hearing in federal court, defense attorneys challenged the case’s legitimacy, pointing to the unusual circumstance that the ex-FBI officials were charged through a criminal complaint signed by a magistrate judge rather than a grand jury indictment. The Justice Department has struggled in the past to secure grand jury indictments in high-profile cases in Washington, D.C.
Hours before the hearing, the Justice Department added a new obstruction charge, alleging the false statements by Floris and Benavides impeded a congressional investigation into the Bidens. Defense lawyers sharply criticized the Justice Department’s actions, stating, “In the middle of the night, the government filed an unsigned and unsworn complaint attempting to fix the issues with their original charge against Ms. Floris and adding a new charge just as meritless as the first one.” They added, “In our combined decades of DOJ service, we have never seen or even heard of something like this being filed.”
Political and Historical Significance of the Case
This prosecution is rare, targeting former FBI employees and revisiting a saga that surfaced in the final weeks of the 2020 presidential race. The laptop’s discovery was controversial, involving Rudy Giuliani, an ally of President Donald Trump, who provided the hard drive to the New York Post. The Biden campaign and some intelligence officials raised concerns about possible Russian involvement in the laptop’s emergence.
Despite those concerns, then-Director of National Intelligence John Ratcliffe stated there was no indication of Russian involvement. The FBI investigated Hunter Biden on gun and tax charges that led to felony convictions, though President Joe Biden pardoned his son in late 2024.
The accused officials, Floris and Benavides, were key figures in the FBI’s Foreign Influence Task Force and had briefed Republican Senators Chuck Grassley and Ron Johnson in August 2020 amid the senators’ investigation into Hunter Biden’s activities in Ukraine. The senators later accused the FBI of undermining their efforts and falsely linking them to Russian disinformation campaigns.
The criminal complaint alleges the former officials lied to lawmakers in 2023 by denying contemporaneous knowledge of the Biden laptop or participation in internal FBI discussions about it.
This case continues to unfold amid intense political scrutiny as the Justice Department navigates these complex charges ahead of the upcoming midterm elections.
The proceedings Tuesday marked a significant rebuke of the Justice Department’s handling of the case but left the original false statements charges intact for the time being.
