Democratic gubernatorial candidate Gina Hinojosa filed a lawsuit on October 19 in Travis County against Texas Governor Greg Abbott to obtain unredacted emails exchanged between Abbott’s office and Elon Musk. The legal move coincides with the start of early voting in the tightly contested Texas governor’s race.

Lawsuit Demands Transparency on Musk Correspondence

Hinojosa’s lawsuit follows a September 29 Texas Public Information Act request seeking to inspect all documents exchanged between Abbott’s office and Musk along with his companies. The governor’s office had previously released some emails to the Texas Newsroom, but Hinojosa asserts that Abbott unlawfully denied her full statutory right to access the complete records.

At an Austin event on October 19, Hinojosa stated, “I have voted and I have also filed a lawsuit today to obtain the documents.” She criticized Abbott, saying, “It is a governor and a government doing the bidding of the moneyed interests, and in this case, the biggest money in the world, instead of the people of Texas, leaving the people of Texas to fend for themselves.”

Abbott Campaign Decries Lawsuit as Political Stunt

The Abbott campaign dismissed the lawsuit as “baseless and an act of desperation by a failing candidate.” Eduardo Leal, press secretary for Texans for Greg Abbott, mocked the legal filing’s errors, highlighting that the case docket listed Abbott incorrectly as attorney general rather than governor. “Gina doesn’t know what she’s doing,” Leal said in a statement.

Within two hours of the lawsuit’s filing, Abbott’s campaign claimed to have submitted all required documents to dismiss the case, seeking to end the dispute quickly as the election nears.

Governor’s Race Remains Tight as Early Voting Begins

Recent polls highlight the competitiveness of the race between Abbott and Hinojosa, who aims to become the first Democrat to win the Texas governor’s office since Ann Richards in 1990. Polling data from October shows narrow margins:

  • University of Houston Hobby poll (Oct. 18): Abbott 49%, Hinojosa 46%
  • Marist poll (Oct. 14): Abbott 49%, Hinojosa 45%
  • UT/Texas Politics Project (Oct. 13): Hinojosa 49%, Abbott 48%
  • ReconMR (Oct. 13): Abbott 48%, Hinojosa 47%
  • UMass Lowell (Oct. 8): Abbott 48%, Hinojosa 44%
  • YouGov (Oct. 6): Hinojosa 48%, Abbott 47%
  • The New York Times (Oct. 3): Hinojosa 49%, Abbott 46%
  • Fox News (Oct. 1): Abbott 52%, Hinojosa 47%

Implications for Transparency and Election Integrity

The lawsuit spotlights concerns about government transparency and the influence of powerful private interests in Texas politics. The correspondence between a sitting governor and a billionaire entrepreneur like Elon Musk raises questions about access and accountability during a critical election period.

As early voting proceeds, voters and observers will watch closely how the legal battle and campaign narratives influence the final outcome in this historically significant gubernatorial race.

The contest between Abbott and Hinojosa remains one of the most closely watched in the country as Texas faces political shifts and growing national attention.

Both campaigns are mobilizing efforts to secure votes in the final days before the November election, with the lawsuit adding another element of scrutiny to Governor Abbott’s relationship with Elon Musk.
