Supreme Court Justice Samuel Alito spoke to CBS News recently, addressing the growing political attacks on the Supreme Court from both President Donald Trump and former President Joe Biden. Alito described these attacks as “harsh” and warned that efforts to politicize the court’s decisions are “quite damaging” to the institution’s integrity and public perception.

Alito on Political Attacks Against the Court

Justice Alito acknowledged that the Supreme Court has faced unprecedented criticism as it has issued politically controversial rulings in recent years. These decisions have angered various political groups on both sides, including rulings on abortion, LGBTQ rights, tariffs, and birthright citizenship. When questioned about whether the court is “damaged” by partisan attacks from political leaders, Alito agreed, stating that such attacks can be “quite damaging” to the Supreme Court as an institution.

He highlighted a “great change” in the way presidents respond to court rulings, noting that recent leaders have moved beyond expressing disappointment and have instead openly attacked the court. This shift, Alito implied, undermines respect for the judiciary and its role.

Trump and Biden’s Harsh Criticism

Alito declined to single out President Trump’s attacks alone, pointing out that President Biden has also been very critical of the court. He said, “Biden was very harsh, and President Trump has been very harsh.” Trump has frequently lashed out at the court on Truth Social, calling it a “shell of its former self” and accusing justices he appointed of lacking loyalty and courage. Biden has criticized the court as “extreme” and called for term limits for justices, while also denouncing rulings that granted Trump greater immunity from criminal charges.

Despite Trump’s criticisms of the court, Justice Alito has not been a target of the president’s attacks. Alito, along with Justice Clarence Thomas, has typically sided with Trump’s policies during his second term. According to the Brennan Center for Justice, the Supreme Court’s “shadow docket” rulings have favored Trump 24 times out of 32 decisions.

The Court’s Upcoming Term and Alito’s Recusal

The Supreme Court’s new term begins next week and will include cases related to Trump administration policies, such as disputes over immigration rules, the federal assault weapons ban, and voting requirements. The court will also hear a major climate change case concerning whether fossil fuel companies can be sued in state court over their role in climate impacts.

Justice Alito notably recused himself from the climate change case on Monday due to pressure from advocacy groups related to his fossil fuel investments. This unexpected move marks a notable moment as the court tackles significant environmental and political issues.

Alito on the Role of the Supreme Court

Defending the court’s impartiality, Alito told CBS, “We are not part of any political movement, and we are not attempting to further any political agenda.” He emphasized that the justices are focused on interpreting the Constitution and applying it to cases fairly, despite the political pressures and public criticism.

As the court faces increased scrutiny from political leaders and the public, Alito’s comments underline the challenges the judiciary confronts in maintaining its independence and authority amid a polarized political climate.

With the Supreme Court’s new term set to address critical and contentious issues, the court’s role and public perception will remain under the spotlight, underscoring the importance of judicial independence and respect for legal processes.
