The Justice Department has disclosed that a search warrant connected to U.S. Representative Ilhan Omar remains only partially executed and extends to other individuals, according to a recent federal court filing. The warrant is tied to an investigation involving potential immigration-related crimes and is still active as authorities continue their probe.
Details of the Warrant and Investigation
According to a redacted 47-page document filed on Tuesday, Homeland Security Investigations agents searched Omar’s Washington residence at approximately 6:05 a.m. on October 12. The filing stated, “the United States expects that the warrant will be fully executed in short order,” indicating ongoing investigative activity. The search aims to gather evidence potentially related to an “immigration-crime conspiracy, including making a false statement,” although much of the evidence remains sealed and no charges against Omar have been announced.
Extension Beyond Ilhan Omar
The court filing also clarifies that the investigation is not limited to Omar alone. It states, “the investigation of [the Subject and] other individuals continues,” though it does not reveal the identities or roles of these other persons. Federal investigators have issued more than a dozen grand jury subpoenas as part of the probe, including subpoenas to some of Omar’s relatives in Minnesota, suggesting the inquiry spans beyond the search of her Washington home.
Allegations and Responses
Omar has faced longstanding, unproven claims that her former husband, Ahmed Nur Said Elmi, is in fact her brother, and that their marriage was intended to secure immigration benefits. Omar has consistently denied these allegations. Following the search, she dismissed the brother-marriage claim as “insane” in an interview with MSNOW, responding sarcastically when asked if Elmi was related to her, though her spokesperson emphasized she has “repeatedly and unequivocally denied” the allegation.
Justice Department’s Position and Court Requests
U.S. Attorney General Todd Blanche approved the warrant and confirmed that its timing was not intended to influence any election or political party advantage. Prosecutors requested advance notice should the court decide to unseal the search records, citing privacy concerns and the risk of compromising the investigation. They warned that releasing records prematurely could allow evidence to be moved or destroyed, or witnesses to coordinate stories. The DOJ indicated it may file an emergency motion to halt any unsealing pending appeal and suggested some records could be released with redactions after the warrant’s full execution.
Political Context and Upcoming Election
Amid the ongoing investigation, Omar is preparing to face Republican challenger John Nagel, a retired Minnesota State Patrol lieutenant, in the November 3 general election for Minnesota’s 5th Congressional District. The administration is investigating whether Omar or her late father provided false information during their immigration process when arriving as refugees in the 1990s or when obtaining citizenship in 2000.
The investigation involving Rep. Ilhan Omar is unfolding with significant legal and political implications as authorities work to complete the warrant execution and gather evidence from multiple individuals connected to the case.
